Is Michigan easy to homeschool in?

According to the Home School Legal Defense Association (HSLDA), Michigan is considered to have relatively accessible and flexible homeschooling laws. The state provides two primary legal avenues for homeschooling: under the homeschool statute and as a nonpublic school, each with distinct requirements and options for parents.

Under the homeschool statute option 1, parents are required to provide an organized educational program that includes instruction in a specific set of subjects. These subjects are reading, spelling, mathematics, science, history, civics, literature, writing, and English grammar. The statute is relatively lenient as it does not require parents to notify local government or educational authorities about their decision to homeschool. This lack of a notification requirement means that parents can begin homeschooling without any formal process or state oversight. The statute also explicitly authorizes parents to provide home instruction, thereby granting them the autonomy to educate their children without interference. However, if someone other than the parent is significantly involved in the child's instruction, HSLDA advises its members to seek specific guidance, ensuring compliance with any potential legal nuances.

For parents who choose to homeschool under the nonpublic school option, there are additional requirements and a higher level of formality. One of the main requirements is related to the qualifications of the instructor. The instructor, who can be either the parent or another person chosen by the parent, must possess a teaching certificate, a teaching permit, or a bachelor’s degree. However, parents who have religious objections to teacher certification can be exempted from this requirement, provided they themselves are the instructors. This exemption does not extend to non-parent instructors, who must still meet the qualification criteria.

Furthermore, families homeschooling as a nonpublic school must provide annual notification to the local public school superintendent. This notification should include the name and age of each child enrolled, the name of the school district, the city or township and county of residence, the parent's name and address, and the name and age of any child not in regular attendance. Additionally, while there is no requirement to submit this information unless requested in writing by the Michigan Department of Education, parents should be prepared to provide records of pupil enrollment, courses of study, and qualifications of teachers if asked. The state provides Form SM-4325 to facilitate this reporting process.

Both homeschooling options in Michigan necessitate instruction in a specific set of subjects. For the homeschool statute, required subjects include reading, spelling, mathematics, science, history, civics, literature, writing, and English grammar. For those homeschooling as a nonpublic school, the curriculum must include mathematics, reading, English, science, social studies, health, and physical education for all grades. High school students must also be taught about the US Constitution, the Michigan Constitution, and the history and structure of government in the United States, Michigan, and local political subdivisions.

While the state does not dictate how often these subjects must be taught or at what grade levels, HSLDA generally recommends that all required subjects be taught at an age-appropriate level annually during elementary and middle school and at least once during high school. This broad approach allows for significant flexibility in curriculum planning and educational approach, accommodating a wide range of educational philosophies and family needs. Overall, Michigan's homeschooling laws offer a balanced blend of required structure and parental freedom, making it one of the more flexible states for homeschooling families.
